While waiting for my feet to heal up I've been dabbling in graphic design, art and photography. The one thing I've run across is that there are a boat load of people out there that apparently have never heard the terms copyright, trademark or intellectual property rights.

Then again there is another boat load of people that have heard those terms, are dishonest and don't care.

I have seen my photos lots of places. Some are even being used as Facebook profile pictures.
WOW! HAVE YOU ASKED THEM ABOUT YOUR PICS WHEN YOU SEE THEM? I UNDERSTAND LIKING A PHOTO BUT ITS COMMON COURTESY TO ASK IF YOU CAN USE IT AS YOURS.

I think one of the problems is that you can pull images from google image search without even knowing who they are from. There should be a way for webmasters to force the source of the image on to the middle of the image when someone tries to pull the image from a page.

I have actually run into this issue when publishing our "Tank Tales" at ACLC - folks don't realize the consequences of using other people's photos without permission. Some have tried to use photos from "public websites" - I think i have caught every one so far . Not many, just enough to keep me on my toes. I try to have folks send me a note acknowledging permission from the photographer if the photo wasn't theirs.

As a professional photographer ( past president of the Maryland Professional Photographers Asociation, currently a member of the Professional Photographers of America (PPA) and the American Society of Photographers. I am actually on the PPA RECON team which goes around and tests stores compliance with copyright laws) This is an issue I face every day. when you make your living creating images for peole either for hanging on thier wall or use on thier website copying of photographs is taking money out of my pocket.

It's not just a matter of people taking images from websites but also scanning images at home or taking them to the local department store and having copies made.

You are correct in that most people are not aware that it is a violation of a federal law. and most ( not all believe me not all ) will honor the copyright if they are educated.

Most pro photogs will put thier logo on the images but with all the photoshop classes being held in colleges or even by other photographers the logo is useless because one of the first thing they teach is how to use the healing or cloning tools to get rid of unwanted portions of the image.

I actually register all of my images with the federal copyright office. I do this before anyone sees the images. The reason being is if I have some one do a flagarent violation ( Another photographer use one my images on thier website and it does happen) I can take them to court and be awarded up to $250,000.

Not to go off topic but do you know that almost everyone of us has violated the copyright laws at one time or another? Anyone who has made a copy of a record ( OK CD) or recorded a song off the radio or scanned a school photo to upload to grandma and grandpa has violated the copyright laws I just wanted to point that out because it is so easy to violate this law and not even realize it

It's not difficult to enforce the copyright the problem comes from finding where the images are being used.

Most are people I know :)

I get requests every couple of months to use an image or 2 on a website somewhere in the world. I have never said no, all I ask is that the leave in unaltered and give credit to the photographer.

I've been asked for permission to use my photos on websites and have never has a problem giving permission.

I just upgraded to Photoshop CS5 from 3 and wow. You can now take something out of a picture like a person standing in front of a brick wall and photoshop will replicate the wall. How cool is that? With that and 3d repousse it's the coolest version yet. Anyway....with that it's even easier for someone to remove watermarks and copyright information.

There are sites that pop up all the time that are built with the intent purpose of scanning the internet and stealing artwork and photos for resale. It isn't all that difficult to get those images removed and the site shut down in some cases by the host company. As John said, it's not enforcing copyright it's finding the images out there that is the difficult part.
